2. Scope
These general terms and conditions (GTC) apply to all contracts concluded between the customer and the provider via the online shop **"The Performance Shop"**. Deviating conditions of the customer will not be recognized unless the provider expressly agrees to their validity.
3. Products and services offered
**The Performance Shop** offers the following products:
- **Car tuning and spare parts**: Products for improving the performance and maintaining motor vehicles.
- **Car care products**: Products for the care and cleaning of motor vehicles.
- **Shop vouchers**: Vouchers that can be redeemed in the online shop of **The Performance Shop**.
4. Conclusion of contract
The contract is concluded as follows:
- **Binding order**: By clicking the button "Order with payment", the customer makes a binding offer to conclude a purchase contract.
- **Acceptance of the offer**: The contract is only concluded with the shipping confirmation or delivery of the goods. The automated order confirmation only serves to inform you that the order has been received and does not constitute acceptance of the offer.
5. Prices and shipping costs
All prices quoted include VAT. Shipping costs are calculated separately and are clearly displayed before the order process is completed. The amount of shipping costs depends on the destination country and the weight of the products ordered.
6. Shipping conditions and transfer of risk
- **Shipping areas**: Shipping is worldwide.
- **Delivery times**:
- For items in stock, the delivery time is usually 3 to 5 working days.
- For products not in stock that are shipped directly to the customer by the manufacturer or wholesaler, exact delivery times cannot be given.
- **Transfer of risk**:
The risk of accidental loss and accidental deterioration of the goods passes to the customer or an authorized person upon delivery. When the goods are shipped to consumers, the risk only passes to the customer upon actual delivery of the goods.
The customer is obliged to check the goods upon delivery by the deliverer before confirming receipt with a signature. **If the goods are damaged or defective, the customer must not accept the delivery and must not sign for it**. In such a case, the goods should be returned to the deliverer and the provider should be notified immediately.
7. Terms of payment
The following payment methods are accepted in **The Performance Shop**:
- **Credit and debit cards**: Visa, Mastercard, American Express, Discover
- **Digital Wallets**: Apple Pay, Google Pay, Shop Pay
- **Installment payment**: Shop Pay Installments (available depending on country)
- **PayPal**: As an alternative payment method
- The provider reserves the right to exclude certain payment methods for individual orders.
8. Right of withdrawal and right of return
1. **Right of withdrawal for consumers**:
Consumers have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period shall be 14 days from the day on which the customer or a third party other than the carrier designated by him takes possession of the goods.
2. **Returnable products**:
The customer can only return products that:
- are unopened and in a resalable condition,
- are not damaged and their packaging is also intact,
- be properly packaged and returned safely to the provider.
3. **Exclusions from the right of withdrawal**:
The following products are excluded from return and cancellation:
- Personalized or custom-ordered products
- Special offer items (e.g. savings sets)
- Products with an expiration date
- car care products
- Vouchers purchased in the shop (payment of the voucher value is excluded)
9. Warranty
- **Legal warranty**: Consumers have a legal warranty period of 2 years from the date of delivery of the goods. For business customers, the warranty period is reduced to 12 months.
- **Manufacturer's warranty**: The products may also be covered by a manufacturer's warranty. In this case, the terms and conditions of the respective product manufacturer apply.
- In the event of defects, the customer has the right to request repair or replacement. If this fails, the customer can request a reduction in the purchase price or withdraw from the contract.
10. Limitations of Liability
- The provider is only liable in the event of intent or gross negligence. The provider is only liable for minor negligence if a material contractual obligation (cardinal obligation) is breached, but is limited to foreseeable, contract-typical damage.
- Liability for indirect damages, in particular for lost profits, is excluded.
- The provider is not liable for damages caused by improper use or maintenance of the products.
- Liability for damages resulting from injury to life, body or health remains unaffected.
11. Final provisions
- The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
- Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
- The place of jurisdiction for all disputes arising from contracts with merchants, legal entities under public law or special funds under public law is the registered office of the provider.
