Scope These general terms and conditions (GTC) apply to all contracts concluded between the customer and the provider via the online shop **"The Performance Shop"**. Deviating conditions of the customer will not be recognized unless the provider expressly agrees to their validity. 3. Products and services offered **The Performance Shop** offers the following products: - **Car tuning and spare parts**: Products for improving the performance and maintaining motor vehicles. - **Car care products**: Products for the care and cleaning of motor vehicles. - **Shop vouchers**: Vouchers that can be redeemed in the online shop of **The Performance Shop**. 4. Conclusion of contract The contract is concluded as follows: - **Binding order**: By clicking the button "Order with payment", the customer makes a binding offer to conclude a purchase contract. - **Acceptance of the offer**: The contract is only concluded with the shipping confirmation or delivery of the goods. The automated order confirmation only serves to inform you that the order has been received and does not constitute acceptance of the offer. 5. Prices and shipping costs All prices quoted include VAT. Shipping costs are calculated separately and are clearly displayed before the order process is completed. The amount of shipping costs depends on the destination country and the weight of the products ordered. 6. Right of withdrawal and right of return 1. **Right of withdrawal for consumers**: Consumers have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period shall be 14 days from the day on which the customer or a third party other than the carrier designated by him takes possession of the goods. 2. **Returnable products**: The customer can only return products that: - are unopened and in a resalable condition, - are not damaged and their packaging is also intact, - be properly packaged and returned safely to the provider. 3. **Exclusions from the right of withdrawal**: The following products are excluded from return and cancellation: - Personalized or custom-ordered products - Special offer items (e.g. savings sets) - Products with an expiration date - car care products - Vouchers purchased in the shop (payment of the voucher value is excluded) 9. Warranty - **Legal warranty**: Consumers have a legal warranty period of 2 years from the date of delivery of the goods. For business customers, the warranty period is reduced to 12 months. - **Manufacturer's warranty**: The products may also be covered by a manufacturer's warranty. In this case, the terms and conditions of the respective product manufacturer apply. - In the event of defects, the customer has the right to request repair or replacement. If this fails, the customer can request a reduction in the purchase price or withdraw from the contract. 10. Limitations of Liability - The provider is only liable in the event of intent or gross negligence.
