Scope These general terms and conditions (GTC) apply to all contracts concluded between the customer and the provider via the online shop **"The Performance Shop"**. Deviating conditions of the customer will not be recognized unless the provider expressly agrees to their validity. 3. Products and services offered **The Performance Shop** offers the following products: - **Car tuning and spare parts**: Products for improving the performance and maintaining motor vehicles. - **Car care products**: Products for the care and cleaning of motor vehicles. - **Shop vouchers**: Vouchers that can be redeemed in the online shop of **The Performance Shop**. 4. Conclusion of contract The contract is concluded as follows: - **Binding order**: By clicking the button "Order with payment", the customer makes a binding offer to conclude a purchase contract. - **Acceptance of the offer**: The contract is only concluded with the shipping confirmation or delivery of the goods. The automated order confirmation only serves to inform you that the order has been received and does not constitute acceptance of the offer. 5. Prices and shipping costs All prices quoted include VAT. Shipping costs are calculated separately and are clearly displayed before the order process is completed. Warranty - **Legal warranty**: Consumers have a legal warranty period of 2 years from the date of delivery of the goods. For business customers, the warranty period is reduced to 12 months. - **Manufacturer's warranty**: The products may also be covered by a manufacturer's warranty. In this case, the terms and conditions of the respective product manufacturer apply. - In the event of defects, the customer has the right to request repair or replacement. If this fails, the customer can request a reduction in the purchase price or withdraw from the contract. 10. Limitations of Liability - The provider is only liable in the event of intent or gross negligence. Final provisions - The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. - Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. - The place of jurisdiction for all disputes arising from contracts with merchants, legal entities under public law or special funds under public law is the registered office of the provider.
